Jees sounds as if this Guy was in a no win situation...
I wonder what would have happened the Guy if he had a few drinks in him? I have read in a few other threads about guys on Motorbikes and jeeps etc having "a few drinks" and then driving... I presume the Police would come down very hard...
This story would make anyone think twice about driving in Phuket...

This is indeed the quandry;
1. Walk = honking tuktuk, bad pavements, hit by drunk driver, covered in dust.
2. Your own motorbike = chance of early death
3. Your own car = chance of big gouge

I've heard such stories so many times. Even if you are stationary at the side of the road in a correct parking area and a Thai person not looking rides into the back of you it will be your fault. And it is both the police AND magistrates who think this way.

Replying to my own post, how sad.
5. Actually there is another option, metered taxis.
These rare beasts can be seen in patong, but they are like timid antelope, ready to dart for lush jungle undergrowth of the patong hill, should the tuk tuk hyena clan start to mob and bay.
The best bet is to collect a few phone numbers of reliable honest meter drivers for your moby.
In an ideal world we could contribute them to a sticky, but that might break forum rules. What do folks think?

Simple rules here, if a bike has an accident with a pedestrian its the bikes fault, if a car with a bike, its the cars fault and if a Farang with a Thai its the Farangs fault, seems fairly simple and clear to me, to even up the odds get a local to assist in negotiations with the police and smile a lot.
Don't all jump on the band wagon of Thailand bashing cos it is exactly the same back home, do you really think your local policeman would side with a non-speaking foreigner??

Well one of the guest at SB was/is in the situation
now.He is Canadian and they hold hes passport back
so he cant travel home before the settelment are done with the the aggrieved part.The funny thing is that it was the aggrieved part foult, but they want to
squeeze him for money rest of hes life,and dont sign any papers before he agree on compensate big money,and he dont get hes passport back before they have sign the papers so it can go to court.
Unnecessary to say he is desperate and in not good mood at the time.

Where I’m from, Donegal, Ireland. The Guards (Police) would probably "do" both the local and the foreigner for anything they could get!!!!
O... And if there were any unsolved murders or bank robberies you could find that pinned on you as well! There was a huge scandal involving the Police here in Ireland just recently… Some of the details were mad… Stuff like collusion with “Paramilitaries”, hoax arms finds etc.
They always get their man! Innocent, Guilty???? Who cares?
Thank Feck it’s being sorted out at the moment…

i was also there at the tsunami when they were more useless than a dog's ****

It's not like that in the UK, whoever causes the accident takes the blame regardless of where anyone is from (as long as all parties are legit obviously).
If I had an accident back home and I caused it, then it wouldn't matter one iota where the other party were from, I'd be coughing up for the damage to them. And I wouldn't expect my local copper to side with anyone, that's not their job, they are there to report the facts and if necessary provide them to the insurance companies.

You know I hear this all the time but its never been the case for me..
accident 1 my fault totally.. I was a mega pissed tourist.. I ran away and the police had to give chase and caught me jumping a wall.. I got a 50/50 payment on his damage as I lied a lot..
accident 2.. I was very drunk out of safari at 7 am ish but it wasnt all my fault.. The thai guy pulled out into the path of me but as I say i was drunk.. I was going to simply pay but they made it a big scene and wanted to take me for a ride.. this was the one that turned into the 10 on one fight in the street and the police came onto the scene while I was kicking a guy who was on the ground.. Really thought I was screwed. Police realized they were trying to intimidate me, we all got arrested, thai guy from the fight was flipping, he was handcuffed and you could hear him screaming in the cells downstairs.. They sent him to the monkey house for a few days to cool off in the end even took me to one side so I could see and laugh at him from behind a window while they loaded him into the back of the pickup (very roughly face down while hancuffed behind his back) and sorted the damage to 2 grand baht which I would have paid all along if they hadnt all tried to come all heavy on me and kicked off.. So again on my side in a way and very fair.
Accident 3 totally his fault.. Tried to run away but I kicked him back off his bike as he was fleeing.. Police turned up.. Arrested him, he plead poverty but police said he had to pay damage or I could send him monkey house.. he paid 4k baht at a meeting set up in cop shop.
All in all in Patong I have found them totally fair to me despite all the tales and stories.. Of course upcountry I suspect that Thai love Thai may band together more but in Patong in my experiences i have found it not bad... I would certainly go into any situation expecting to be compensated but realize it may not work out as hoped for.. No way I would just roll over and think 'thats how it is'..
