Farang / Thai baby and dual citizenship

I contacted my embassy and asked what I need to give my daughter Swedish citizenship and to be able to apply for Swedish passport for her.

I need a paper from Thai Family Court that prove I am the father. Anyone can recommend a lawyer for this?

I have asked one lawyer and they asked for 45,000 baht, which sounds very expensive to me. (But this law firm is one of the best around and everything they do they charge a lot for it)

Another option is to marry, then the child will get Swedish citizenship automatically. But before that will be any option, I need to know everything how this will affect me and my girlfriend and what happens if we divorce in the future. Anyone who know about this?

I think I recall Thai people who marry to a farang can only own 1 rai land in Thailand, and I also read long time ago that authorities in Pattaya wouldnt let wifes to foreigners own a bar, for example.

I am sure there are lot of things you should be aware of.

I have been married to a TG for 15 years now (+ 2 years as GF) and my son is 9 years old. We have just got him his Thai nationality so he now has duel nationality Thai /british & this means he can inherit the land that I just bought in Phuket through my wife & she was able to buy more than 1 rai. If we divorce she gets the land but can't kick me out as I have a 30 year lease on the house signed with a lawyer. I used a guy called Poolsuk @ G & associates in 116/12 Patipat road who was cheaper than falang lawyers. IMHO you should marry your GF & then your daughter will have several options in her future ( believe me time goes by so quickly ). I got married outside of Thailand ( in Hong Kong ) so don't know how this affects local law also don't know anything about owning a bar BUT I can say that the laws in Thailand are changing for the better every year and you shouldn't believe all you hear.
Your embassy should be able to give you all this info…

BTW - I'll be coming to yer bar next month do you have Guinness?

Nicke, call me for a great value but highly attentive Thai lawyer, she specializes in Land and its associated legal issues (of course she does its Phuket) but as far as I know she does all sort of things...

Marriages in Thailand seem to have very little effect or claim outside of Thailand if your girl does not get there, of course if she makes it Europe (even years later) and shows the marriage details then, it can be possible to claim back maintenance etc..

As to land ownership, the law you mention is no longer valid. A Thai national married to a farang can own as much land as she can afford. The only unusual part is so that a farang cannot lay claim to the land (we cant own shit) she must sign a declaration that says all the money is hers and not lent to her or yours. Hence if you ever break up the land is soley and wholly hers.

As far as my understanding of the law goes if you register as the father and gain your daughter citizenship of your country and Ead has registered the birth here with a Thai parent he is fully a dual national of both states, marriage does not afford her any additional rights once she is registered as a citizen of each.

I talked with another guy who also done this last year, and he paid 17,000 for his Thai lawyer.

However, I was surprised to hear what questions they ask at the family court, e.g. how good the man take care of the baby and wife, how much money he give and so on. Everything was in Thai so he dont know everything they asked, but it was a lot. Hm.

Some advice

Hi Nicke,

If I were you I'd get some advice from a lawyer in my home country in addition to getting some Thai legal advice. Someone that specializes in family law. Ideally, you should find out not only how marriage might affect you in Thailand, but how the courts in your home country (Sweeden?) might view it all.

Don't get married

The common theme I've found with marriages is once you do it a couple of things happen:

1. Forget about sex (with you wife) a monthly appointment will be established.

2. Usually the wife will feel obliged to put on 30 pounds (mostly farang women and not always the case) the man will feel obliged to put on 30 pounds as well.

3. They usually ask some silly question during the ceremony like "You will love, honor, cherish and not shag anyone else the rest of your life" and you the groom takes a big gulp and meekly says yes.

4. Thai families as we know expect some payola (dowery) so they may show all in the village and gain face. This part makes you feel good but it stings taking it out of the bank. Anyways you probably are allready sending cash back just in smaller amounts (or Ead is anyways)

Just a bachelors viewpoint.
