question - allow to use photos!
As many of you BM's know I made a movie clip back in 2004 based on photos from this forum. I'm now updating my homepage during server change. And I will release it wit some new features as photogallery. I have many of the photos from my videoclip stored on my pc, and wondring if it's ok for you guys out there that i use some of those picture in the clip in my gallery?
Better to ask first befor i begin to upload them.
My site will be up and running again in the end of this week i hope. The coding and design is finished, just waiting on my host to transfere my domain to their server.

Wouldn't it be better to PM the persons who took the photos. If I was the photographer ( Iam sure I am not - my photos are too boring) I would like to know it and which ones you planned to use.

It's very long time since i downloaded the pictures, and it takes a little time to find out who post the pictures, anyway not a big deal, maybe i drop to use the photos, but i was thinking maybe it would be nice to get many of the old photos from this forum in one gallery so members can wiev. i can always make a password protected gallery so only bm's can enter =)

I remember when that came out and a few people didn't like it...I think bringing it up and asking now before a updated release is fair enough.
As I have stated in the past if you post a photo in a public area its a freebie and as you have made said photo availible then there is nothing stopping someone else from downloading said photo. Your not reproducing for profit so therefore the photos use shouldn't be an issue.
That being said I think you've done all you need to do and brought it up, I look forward to seeing your new work.

Just wearing my writers hat for a minute; don't assume that everything that is on the internet is free for you to use.
All web content and pictures are protected by copyright unless they are specifically not copyright protected. You cannot just lift words or pictures and use them yourself, they all belong to somebody.
I'm not saying you can't do what you want to DJ, just saying be aware that they do belong to somebody and you really might want to seek permission before re-producing them elsewhere.

I think it is only common curtiosy to ask before using someone else's material. The internet and its contents aren't free range, contrary to poeple's beliefs.

To make a very long story short. No. Unless you have written permission to publish a photo from the creator, he can charge 3 times the normal published amounts for the publication type as adviced by the branche organisations. And these will cost you a lot. So never publish pictures you not have the rights of or that are not royalty free.

I think you should have made the story shorter and stopped after "No". No idea what you're talking about. I don't think the issue would be money since few if any of the people that post pics here got paid for them so 3 x 0 is still zero. Go ahead an use any of mine.

djmyst IMHO has done the right thing some BMs have responded with "yea sure use what you like",guess his next step is to PM any BMs whose photos he wants to use who havent said ok.
dont think he will have a PROBLEM he has done the right thing.
Only thing is maybe using some Thai girls who dont want to be seen,this has been discussed before plenty of times,and as most of the photos of girls are decent on this forum cant see a problem.
(small side story here who owns copyright the person taking the photo or the subject of the photo,know the legal answer what about the moral answer)

I know about copyright materials.
I dont think thoose who don't like that i took the photos for the movieclip i made have answerd my question yet. I will not use pictures from them in the gallery. Hole ide of using pictures from here, is just to put them in one category so bms from here can see what pictures have been postet before. And of course this is for non benefit or commercial us.
I'm working on a script now, that just alows bm's to enter that folder with pictures from here. If you want to see the pictures you have to enter your username of this forum in a form. After a chek of the username is valid or not, you recive a password on mail or pm, and have access to the gallery. So then no other than people that is sign up here or sign up later can see them...
a little work to do but this can be the solution.... or i can do it the simpel way, just don't use the photos from here 555555.

Spot on. Intellectual property rights are a bit of an interest for me but the internet makes enforcing them very impractical. Reproducing anything, words or images, on a website without permission is a breach of copyright, doing anything about it would be very tricky.
I've had articles lifted wholesale and reproduced, when I found them I just e-mailed the site owner and asked him to acknowledge my work with a link back to the source.
The reality is that once you post something on a website you lose control of it. Photographers have a particular problem because their work, once placed in the shop window it needs, is very easy to steal. I'm not surprised they are touchy about it.
