German Stabbed to Death in Phuket
Tuesday, December 13, 2005
German, 25, stabbed to death
PATONG: A 25-year-old German man died early on Sunday morning of stab wounds received in a furious argument with his Thai girlfriend in their rented room on Nanai Rd.
Pol Lt Col Chawalit Niamwadee, of Kathu Police Station, told the Gazette, “I received a call from Patong Hospital at 4 am that a man had been brought into the emergency room, where he had died of his wounds.”
The dead man was identified as Anders Ochner. “He had been stabbed once in his right side and once in his upper chest, and he had three knife wounds to his right hand,” said Col Chawalit.
“At the scene of the stabbing, I found Uthairat Poonchan, 21, from Nakhon Sawan, still holding a knife. There was blood on the floor.
“She told me that she and Mr Ochners frequently had arguments about the victim’s relationships with other women. She had used the knife to protect herself, she said, because he had hit and hurt her before. She herself had cuts to her fingers and her right arm.”
Uthairat, he said, had been arrested on a charge of manslaughter. The investigation continues.
Mr Ochner’s body is currently at Thalang Hospital awaiting collection by his relatives.

Avoid girls with hot temper.
I talked to another man recently, he told me he will never have a Thai gf again, he was also stabbed on the side/back in the past and have a big scar left.

Manslaughter ?? she stabs him with a knife and kills him sounds like murder to me..

If he was stabbed in the heat of an argument then plod would assume no premeditation, making the crime manslaughter rather than murder.

Surely manslaughter is accidentally killing someone murder can still be a crime of passion and not pre meditated..
Paul Killed debbie in a drunken argument.. Hes on a murder charge..

I guess that is Thailand LIL.
I think one difference between murder and manslaughter (in the UK) is as to whether or not the person MEANT to kill the victim.
Another aspect is as to whether or not the act of violence is LIKELY to result in a persons death.e.g. skull like an eggshell and the victim is killed by a single blow.
IMO the benefit of the doubt is given to far to many criminals. Some youths today have just been found guilty of killing a barman in London. They committed 8 acts of violence against different people within 1 hour, the last one resulting in the death of a barman, who ironically survived a bombing in Soho a few years ago. Got off a murder charge and found guilty of manslaughter.

Well, if you use a knife to hurt somebody I think I would say it is murder due to the weapon chosed.
If she hit him in the head with a stick/bottle or whatever and died then I could agree with manslaughter.
Most normal western people would never use a knife, regardless how angry their are.

I agree with the above that if you mean to kill someone its murder.. if you accidentally kill someone, if you kill someone while trying to defend yourself (or use too much force as in the 'reasonable force' arguement), if you kill somone in a crime of passion or argument without the intention to kill them.. That makes Manslaughter IMHO..
If you try to kill someone its murder and if you plan to kill someone its then premeditated murder..
This case the murder weapon and the impression is one of either murder or premediated murder IMHO but its manslaughter.. Paul and Debbies came under accidental death or at the very worst a crime of passion (drunken argument) resulting in Paul killing her.. That was murder.. Just seems unfair justice but there you go, if Paul had some money he could have had a manslaughter rap and if he had a chunk of money he would probably be free.. TiT..

I have noticed that Turks, italians and Spanish seem to carry knives a lot more than any other Euro's.. Not sure why its more common in the latin peoples and not making any bad generalizations just a comment..
It was turks thats stabbed me..

But this incident remembers me of one i had last month in patong. A "firsttimer to thailand" brought me in trouble... Some TGs are better to avoid. But some people just don`t believe.....

hehe she did put on quite a show didn't she. I still take the piss out of her for it but I wouldn't mess with her if she 'lost it' again.
Intended victim was another girl who worked at MTB - forget her name but she doesn't work there now. Nothing to do with the incident tho - they were chatting away next day.

MANSLAUGHTER - The unlawful killing of a human being without malice or premeditation, either express or implied; distinguished from murder, which requires malicious intent.
The distinctions between manslaughter and murder, consists in the following: In the former, though the act which occasions the death be unlawful, or likely to be attended with bodily mischief, yet the malice, either express or implied, which is the very essence of murder, is presumed to be wanting in manslaughter.
It also differs from murder in this, that there can be no accessaries before the fact, there having been no time for premeditation. Manslaugbter is voluntary, when it happens upon a sudden heat; or involuntary, when it takes place in the commission of some unlawful act.
The cases of manslaughter may be classed as follows those which take place in consequence of: 1. Provocation. 2. Mutual combat. 3. Resistance to public officers, etc. 4. Killing in the prosecution of an unlawful or wanton act. 5. Killing in the prosecution of a lawful act, improperly performed, or performed without lawful authority.
