West Ham's position was never in doubt, not at this recent hearing. All they were doing was deciding whether Sheffield United should be re-instated or not. The panel could have recommended a new hearing to take the fine versus deduction of points issue up again, but they decided against it...

"The three-man panel, headed by retired High Court judge Sir Philip Otton, did not have the power to change West Ham's punishment but could have ordered a new independent commission to judge the case."
